SCHOOLS CONDITIONS OF ENTRY
 
McCAIN School Veggie Patches Promotion

 
1. Information on how to enter and Rewards form part of these Conditions of Entry. Entry into this promotion is deemed acceptance of these Conditions of Entry by each Eligible School.

2. Promotion commences at 09:00 am AEST on 27/04/2011 and closes at 11:59pm AEST on 30/09/2011 (Promotion Period). The Promoter’s decision in relation to all aspects of this promotion is final and no correspondence will be entered into.
 
3. Entry into the promotion is open to all primary schools in all Australian States and Territories and in New Zealand including those that receive an invitation from the Promoter prior to or during the Promotion Period (Eligible School).

4. To participate in the promotion, during the Promotion Period:
 
(i) The Principal or the Principal’s representative (Representative) of an Eligible School must first log on to www.mccainveggiepatches.com (Promotional Website) and complete in full and submit in the manner required the online registration form by 11:59 pm AEST on 19/08/2011 (Registered School). The Promoter may accept late registrations at its sole discretion. In order to fully complete the online registration form, the Principal or Representative (as applicable) will be required to provide the school name, address, the Principal’s and head of fundraising’s or other Representative’s name, email address, telephone and fax number and the total number of students at the school at the time of registration. The Principal or Representative must also accept these Conditions of Entry.
 
(ii) The Eligible School must be accepted by the Promoter as a Registered School. The Registered School’s name will then appear as a participating school on the Promotional Website. Schools who register and are accepted as a Registered School will be provided with a unique user name and password that the Registered School may use to log in to the relevant section of the Promotional Website. Principals must ensure that the unique user name and password remain secure and confidential. Registered Schools will then be sent a welcome pack in the mail to confirm their registration to the promotion.

(iii) The staff, parents of students, other members of the Registered School or general public aged 15 years or older (Consumers) must then:

(A) purchase any qualifying pack of McCain Frozen Vegetables by 30/09/2011, including any product from McCain Purely Potato, Regular Vegetables, Sweet Baby Vegetables and Mixed Vegetable range including Winter Vegetables, Stir Fry Supreme and other McCain Vegetable Mixes (Eligible Purchase). Excludes all other McCain non-vegetable product ranges e.g frozen pizzas, fries and pre-prepared meals;

(B) log onto the Promotional Website to view a list of Registered Schools that may receive the benefit of the Consumer’s Eligible Purchase and receive Eligible Purchase barcodes and then select the Consumer’s Registered School of choice; and

(C) cut out the barcode(s) on the pack of the Eligible Purchase and either:

1. Submit the original barcode(s) at any time throughout the Promotion Period to their selected Registered School by delivering their barcodes to their selected Registered School by 04/10/2011. Each Registered School will be provided with 3 reply paid envelopes by the Promoter that the Registered School may use to mail the original barcodes to the Promoter in bulk on behalf of the Consumer. In order to send barcodes using the reply paid envelopes, the Principal or representative will be required to:

a. Log onto the Promotional Website and print off a cover letter which details all required information for the Registered School for ease of processing. Enclose the completed cover letter in the reply paid envelope together with the original barcodes; and

b. Provide their full name, the Registered School’s name, address, telephone number and email address of the Registered School and state the number of barcodes sent by the Registered School and then mail this information together with the original barcodes in the reply paid envelopes provided to 'McCain School Veggie Patches', PO BOX 439, Brookvale NSW, Australia 2100 (within Australia) or 'McCain School Veggie Patches', PO BOX 302324, North Harbour, Auckland 0751 (within New Zealand). To be eligible to be counted in the promotion, all barcodes of an Eligible School must be received by last mail to the Promoter on 10/10/2011; or
 
2. as an alternative to (1), Consumers may submit their original barcodes by sending a stamped envelope (usual postage costs will apply at the Consumer’s cost) to 'McCain School Veggie Patches', PO BOX 439, Brookvale NSW, Australia 2100 (within Australia) or “McCain School Veggie Patches”, PO BOX 302324, North Harbour, Auckland 0751 (within New Zealand) together with their name, age, address and also the name, town and state of their selected Registered School that they nominate to receive barcode points by last mail to the Promoter on 10/10/2011. Consumers aged under 18 years must obtain the consent of their parent or legal guardian to participate in the promotion and provide personal information about themselves. All Consumers who are under the age of 18 years and participate in the promotion without disclosing (or attempting to conceal) their age (as and where required) and/or do not provide the required parental consent (as and where required) will be deemed invalid. These Conditions of Entry will bind Consumers who enter the promotion and any parent or legal guardian who gives their consent (for Consumers aged 18 years and under). 5. Each Registered School will be awarded 10 points for every barcode received by the Promoter from 1kg, 1.2 kg and 2 kg packs of an Eligible Purchase and 5 points for every barcode received by the Promoter from all other packs including 400g, 500g, 600g, 750g and 800g packs of an Eligible Purchase in accordance with these Conditions of Entry. Registered Schools will then be able to use their accumulated points to redeem Rewards in accordance with these Conditions of Entry. If a Consumer nominates a school that is not a Registered School or if the nominated school is ineligible, the Promoter will and in its sole discretion either:
 
 
(i) attempt to contact the nominated unregistered school and offer the unregistered school the opportunity to become a Registered School and accept the barcode point(s); or
 
(ii) nominate a Registered School to receive the applicable barcode point(s).
 
6. Early Bird Offer: Schools that become a Registered School by 11:59 pm AEST on 13/05/2011
will automatically be awarded 200 bonus points within five (5) days of registration. The bonus points will appear against the Registered School’s online points total. The bonus points will be treated as barcode points for the purpose of this promotion and may be used to redeem Rewards in accordance with these Conditions of Entry.
 
7. The Promoter accepts no responsibility for late, lost or misdirected online registration forms or mailed barcodes. Registration and barcodes received will be considered final by the Promoter. Incorrect, incomplete or incomprehensible registration forms or barcode submissions will be ineligible. Only original barcodes of Eligible Purchases will be accepted. Copies or images of barcodes are ineligible. Online registrations will be deemed to be accepted at the time of receipt and not the time of transmission. Only one registration per Registered School will be accepted. In the event of a Registered School’s registration by more than one person, only one registration will be accepted and the Promoter will contact the Registered School to determine the main contact person for future correspondence.
 
8. Registered Schools that receive barcode points from Consumers or that collect and submit barcodes on behalf of Consumers to the Promoter in accordance with these Conditions of Entry will be able to use their accumulated barcode points to redeem the following McCain Veggie Patch Equipment items in accordance with the item’s availability and point value as stated below (Rewards):
 
(i) 947 x Branded Potato Planter Hessian Bags valued at AUD$9.65/NZ$12.25 each – 75 points each;
(ii) 1810 x Carrot Seeds valued at AUD$5.00/NZ$6.35 each – 35 points each;
(iii) 2274 x Capsicum Seeds valued at AUD$5.00/NZ$6.35 each – 35 points each;

9. Each Registered School that is awarded a sufficient amount of points to enable redemption of Rewards in accordance with these Conditions of Entry may, between 27/04/2011 and 31/10/2011 (Redemption Period), log on to the Promotional Website and follow the online claim process to select their Reward(s) from the relevant range of Rewards that the Registered School has qualified for in accordance with the Promotional Website’s online claim process. Registered Schools are able to commence claiming Reward(s) as soon as they have accumulated sufficient points for the Reward(s) of their choice. To claim a Reward, the Principal or representative (as applicable) must log on to the Promotional Website, check the number of points required for a given Reward, ensure that the Registered School has sufficient points for the Rewards(s) they would like to receive, identify the Reward(s) the Registered School would like to receive, confirm the selected Reward(s) remain available and complete in full, in the manner required and submit the online claim. Registered Schools are only able to claim their Reward(s) in accordance with these Conditions of Entry once per calendar month.
 
10. All online claim forms must be received by the Promoter by 5:00 pm AEST on 31/10/2011 otherwise the Registered School will no longer be eligible to claim a Reward and all remaining barcode points may be deemed expired. The Promoter may extend the Redemption Period in its sole discretion. The Promoter accepts no responsibility for late, lost or misdirected claim forms. Claim forms received will be considered final by the Promoter. Claim forms will be deemed to be accepted at the time of receipt and not the time of transmission. Incorrect, incomplete or incomprehensible claim forms will be ineligible.
 
11. All barcodes received by the Promoter will remain the property of the Promoter.
 
12. Rewards will be delivered/mailed to the Registered School within 30 days of receipt of a valid online claim by the Promoter or will be redeemable by way of a Mitre 10 rewards voucher that will be also be mailed to the applicable Registered School. The Registered School will be responsible for redeeming the rewards voucher at the Registered School’s local Mitre 10 store. Rewards vouchers are subject to their own prevailing conditions of use and expiry dates.  The Promoter will not be responsible for any lost, damaged or stolen rewards vouchers.
 
13. Rewards are not transferable or exchangeable and cannot be taken as cash. Rewards must be taken as offered and cannot be varied. The Promoter accepts no responsibility for any tax implications that may arise. Independent financial advice should be sought. All warranty claims and queries in respect of Rewards must be directed towards the applicable manufacturer and not the Promoter. The Promoter makes no warranties in relation to the suitability of any Rewards for certain age groups or fitness for any particular purpose.
 
14. The precise number and/or inclusions of the Rewards stated above are subject to change, and will be determined by the Promoter in its sole discretion. Any changes to the inclusions, however, will not affect the value or general nature of the Reward being offered and will be detailed on the Promotional Website. If any Reward or element of a Reward becomes unavailable for any reason beyond the Promoter’s reasonable control, then a similar Reward or Reward element of equal or greater value will be awarded in lieu.
 
15. Total possible rewards pool value for all Australian and New Zealand Registered Schools is up to AUD$510,640.60 (NZD$584,389.10) (Recommended Retail Price including GST).
 
16. Any costs associated with accessing the Promotional Website remain the responsibility of each Registered School and Consumer and are dependent on the Internet service provider and/or mobile carrier used.
 
17. It is a condition of entry into the promotion that the Principal of each Registered School obtains the required permission from the relevant education authority or committee to agree to these Conditions of Entry, participate in the promotion and redeem Rewards from the Promoter.
 
18. It is a condition of entry and redeeming a Reward that each Registered School sign one or more legal releases in a form determined by the Promoter in its absolute discretion. If the Promoter is unable to secure the required legal releases requested by this Condition to its satisfaction and in the time requested, the Registered School will be deemed ineligible and will not be provided with a Reward.
 
19. Unallocated Rewards remaining unclaimed at the end of the redemption period may be distributed or awarded to Registered Schools in a manner to be determined by the Promoter at its sole discretion.

20. The Promoter reserves the right, in its sole discretion, to extend Promotion Period. Registered Schools and Consumers will be notified of any extension of the Promotion Period via the Promotional Website.    


21.  Should a Registered School have remaining points from the 2010 Redemption Period, the Promoter, in its sole discretion, has the right to advance some or all of those points to that Registered School.  That Registered School may then redeem those points for rewards as if those points had been collected in the 2011 Promotion Period.  The Promoter will communicate this to the Registered School by email to the address provided by the Registered School.   

22. The Promoter reserves the right to request the Principals of the Registered School to produce (within the requested time) appropriate identification or other documentation (to the Promoter’s satisfaction, at its sole discretion) in order to confirm the Principal’s identity, eligibility to claim a Reward and any information submitted by the Principal or representatives of the Registered School before allowing the Registered School to redeem their points. If the documentation required by the Promoter is not received by the Promoter (or its nominated agent) or a Registered School has not been verified or validated to the Promoter’s satisfaction within the time requested, that Registered School will not be eligible to claim a Reward. All Rewards will only be awarded following any validation and verification that the Promoter requires in its sole discretion.
 
23. The Promoter and its associated agencies and companies shall not be liable for any loss (including, without limitation, indirect or consequential loss), damage, personal injury or death which is suffered or sustained (including but not limited to that arising from any person's negligence) in connection with this promotion (including but not limited to use of the Rewards), except any liability that cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
 
 
24. The Promoter reserves the right to verify the validity of entries and claims and reserves the right to disqualify any Registered School or Consumer for tampering with the entry process or for submitting an entry or claim which is not in accordance with these Conditions of Entry, or if a Registered School or Consumer is engaged in any unlawful or other improper misconduct calculated to jeopardise the fair and proper conduct of the promotion. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
 
25. The Promoter will not be responsible for any incorrect, inaccurate or incomplete information communicated in the course of, or in connection with, this promotion if the deficiency is occasioned by any cause outside the reasonable control of the Promoter.
 
26. Caution: any attempt to cause malicious damage or interference with the normal functioning of the Promotional Website or the information on the Promotional Website, or to otherwise undermine the legitimate operation of this promotion may be a violation of criminal and civil laws and should such an attempt be made, whether successful or not, the Promoter reserves the right to seek damages to the fullest extent permitted by law. If the Promoter suffers loss or incurs any costs in connection with any breach of these Conditions of Entry or any other legal obligation by a Registered School, the Registered School agrees to indemnify the Promoter for those losses, damages and costs.
 
27. The Promoter is not responsible for any problems or technical malfunction of any telephone or network or lines, servers or providers, computer equipment, software, technical problems or traffic congestion on a mobile network, or any combination thereof, or any other technical failures including any damage to any person's mobile handset or computer related to, or resulting from, participation in this promotion or the downloading of any materials related to this promotion.
 
28. If for any reason this promotion is not capable of running as planned because of infection by computer virus, bugs, tampering, unauthorised intervention, technical failures or any other causes beyond the reasonable control of the Promoter which corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter reserves the right in its sole discretion to cancel, terminate, modify or suspend the promotion.
 
29. Registered Schools consent to the Promoter using the Registered School’s name, in the event they are awarded a Reward in any media for an unlimited period of time without remuneration or compensation for the purpose of promoting, publicising or marketing this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter. The Registered School agrees to participate in all reasonable promoted activities in relation to this promotion as requested by the Promoter and its agents.
 
30. All entries and any copyright subsisting in the entries become and remain the property of the Promoter (or its nominated agents). The Promoter collects personal information about Registered Schools’ principals or representatives to include Registered Schools in the promotion and where appropriate award Reward(s). If the personal information requested is not provided, the Registered School may not participate in the promotion. By participating in the promotion, each Principal or representative also acknowledges that a further primary purpose for collection of the personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact Registered Schools in the future with information on special offers or provide Registered Schools with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian and New Zealand related companies and promotional partners who may contact Registered Schools with special offers in this way. By entering the promotion, each Registered School agrees that the Promoter may use personal information in this manner. Each Registered School also agrees that the Promoter may publish or cause to be published the Registered School’s name and locality in any media. Registered Schools can also gain access to, update or correct any personal information by contacting the Promoter at the address below or at the contact details stated in the Promoter’s Privacy Policy. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter or via the Privacy Policy link at www.mccainveggiepatches.com.
 

Helping Hand Grants

31. McCain will award one "McCain School Veggie Patches Helping Hand Grant" (Helping Hand Grant) for each month (June, July, August and September) of the Promotional Period.  There are four Helping Hand Grants to be awarded.

32. Registered Schools can enter by:
(1) Submitting their written submission by email to enquiries@mccainveggiepatches.com of no more than (100 words) setting out why that Registered School deserves a Helping Hand Grant.  Entries must be submitted via the supplied email address (located on the promotional website) or sent to 'McCain School Veggie Patches', PO BOX 439, Brookvale NSW, Australia 2100 (within Australia) or 'McCain School Veggie Patches', PO BOX 302324, North Harbour, Auckland 0751 (within New Zealand), to be received by the end of each month's entry period (Eligible Entry). Entry periods for each month are set out below.

(2) Entries must come from the Principal or Representative of the School.  Each Registered School may submit only one Helping Hand Grant entry in each month of the Promotion Period.  If more than one entry is received from a Registered School in the same month, the Promoter will not consider the second or subsequent entries.  Each Eligible Entry will only be considered for the award of the Helping Hand Grant in the month in which it is submitted.  Each Registered School will only be eligible to be awarded one Helping Hand Grant during the Promotion Period. One Helping Hand Grant will be awarded during each month of the Promotion Period to the Eligible Entry judged by the Promoter to be most worthy of receiving a Helping Hand Grant to assist the Registered School with its veggie patch. The promoter has sole discretion in awarding each grant.
33. Each Helping Hand Grant consists of: 3 packets of each seed variety, 5 x packs of kids gloves, 5 x  kids tool sets, 5 x watering cans, 5 x organic soil packs (AU only), 5 x Organic Compost (NZ only), 5 x fertiliser, 5 x water saving mulch (AU only), 5 x Sheep Pellets (NZ only), 2 x packs of adult gloves, 2 x adult tool sets, 2 x plant identifier packs, 2 x PH testers, 2 x wheel barrows, 2 x raised garden beds (AU only), 2 x Wooden Kitset Gardens (NZ only), 2 x compost bins, 2 x hose (NZ only),  and is valued at RRP $1106.61AUD/ 1321.47NZD, (part of this Reward will be provided by way of a redeemable voucher at Mitre 10 Australia and New Zealand)

34. June Entry Period
Eligible Entries for the June Helping Hand Grant must be received between 1 May 2011 and 31 May 2011. The winner will be judged by 7 June 2011 and the Registered School that is awarded the June Helping Hand Grant will be contacted via email within 3 business days of this decision.

35. July Entry Period
Eligible Entries for the July Helping Hand Grant must be received between 1 June 2011 and 30 June 2011. The winner will be judged by 12 July 2011 and the Registered School that is awarded the July Helping Hand Grant will be contacted via email within 3 business days of this decision.

36. August Entry Period
Eligible Entries for the August Helping Hand Grant must be received between 1 July 2011 and 31 July 2011. The winner will be judged by 10 August 2011 and the Registered School that is awarded the August Helping Hand Grant will be contacted via email within 3 business days of this decision.

37. September Entry Period
Eligible Entries for the September Helping Hand Grant must be received between 1 August 2011 and 31 August 2011. All entries and any copyright subsisting in the entries become and remain the property of the Promoter (or its nominated agents). The Promoter collects personal information about Registered Schools’ principals or representatives to include Registered Schools in the promotion and where appropriate award Helping Hand Grants. If the personal information requested is not provided, the Registered School may not participate in the promotion. By participating in the promotion, each Principal or Representative also acknowledges that a further primary purpose for collection of the personal information by the Promoter is to enable the Promoter to use the information to assist the Promoter in improving goods and services and to contact Registered Schools in the future with information on special offers or provide Registered Schools with marketing materials via any medium including mail, telephone and commercial electronic messages. The Promoter may share information with its Australian and New Zealand related companies and promotional partners who may contact Registered Schools with special offers in this way. By entering the promotion, each Registered School agrees that the Promoter may use personal information in this manner. Each Registered School also agrees that the Promoter may publish or cause to be published the Registered School’s name and locality in any media. Registered Schools can also gain access to, update or correct any personal information by contacting the Promoter at the address below or at the contact details stated in the Promoter’s Privacy Policy. All personal information will be stored at the office of the Promoter. A copy of the Promoter’s Privacy Policy in relation to the treatment of personal information collected may be obtained by contacting the Promoter or via the Privacy Policy link at www.mccainveggiepatches.com.

38. Registered Schools, warrant that they have obtained the prior written consent of all persons who appear or who are identified in that Registered School's Helping Hand Grant entry (Participant).  If any Participants are under the age of 18; Registered Schools warrant that they have obtained the prior written consent of the parent or guardian of that Participant.  Such prior written consent must permit the use in any way whatsoever, by the Promoter, of any video recordings, photographic images or any other material submitted as part of the entry in which Participants can be identified.

The Woolworths double points offer is open to all Australian eligible schools for the McCAIN School Veggie Patches Promotion (Woolworths Double Points Offer).

The Woolworths Double Points offer apply to purchases of Eligible Products from participating Woolworths stores between 12.00am (AEST) on 1 July 2011 and 11.59pm (AEST) on 31 July 2011 (Double Points Period).
